In Florida, a Last Will and Testament does not have to be notarized to be legally valid, but many wills include a self-proving affidavit that is signed by the testator and witnesses before a notary. A self-proving affidavit can simplify the probate process because the witnesses generally do not have to later testify that the will was properly executed.

 

While we notarize documents and administer the required oath for a self-proving affidavit, we do not prepare wills, provide legal advice, or explain how an estate plan should be drafted.

If your will includes a self-proving affidavit, the testator and both witnesses must appear together to complete the affidavit before the notary. Because the witnesses' signatures are notarized on the affidavit, the notary cannot also act as one of those witnesses.
